Terms of Service
These Terms of Service ("Terms") govern your use of gogoportapottyplus.com (the "Site") and any quote, order, or rental you arrange through Go Go Porta Potty Plus LLC ("Go Go Porta Potty Plus," "we," "us," or "our"). By using the Site, requesting a quote, paying a deposit, or placing an order, you agree to these Terms. If you are acting for a company, you confirm you have authority to bind it.
1. Our role as a broker
Go Go Porta Potty Plus is a rental brokerage. We do not own trucks, portable toilets, dumpsters, fencing, or other rental equipment. We match your request with an independent, vetted local vendor, confirm your price, coordinate scheduling, and serve as your point of contact and billing contact for the order.
Delivery, setup, servicing, hauling, installation, removal, and pickup are performed by the independent vendor, not by Go Go Porta Potty Plus. Vendors are independent businesses, not our employees or agents, and they are responsible for their equipment, personnel, vehicles, licenses, and insurance. We choose vendors with care, but we do not control how a vendor performs its work.
2. Service area
We arrange rentals in Washington, D.C., Maryland, Virginia, and Georgia. Availability, delivery windows, equipment types, and pricing vary by location and date. We may decline requests outside our service area or where no qualified vendor is available.
3. Quotes and pricing
- Exact quotes are in writing. Your price is confirmed in a written quote (for example, by email) before you pay anything. Unless the quote says otherwise, a written quote is valid for 14 days and is subject to vendor availability until your deposit is received.
- What's not included: unless stated in your quote, prices exclude sales tax, permits, long-distance delivery, and extra services.
- Price changes: your final price may change if the order changes, for example extra units, longer rental periods, additional service visits or swap-outs, dumpster weight over the included tonnage, prohibited or overfilled loads, difficult site access, trip charges for blocked or failed deliveries, or loss of or damage to equipment. We will tell you about additional charges and the reason for them.
4. Deposits and payment
- A deposit reserves your delivery date. The deposit amount is shown on your written quote and is applied toward your order total.
- Payments are processed securely by Stripe by bank transfer (ACH) or card. We do not store card numbers. ACH payments usually clear in 3–4 business days, and your reservation is held while the payment clears.
- Unless your quote states otherwise, the remaining balance is due before delivery for event rentals, and monthly in advance for construction rentals.
- If a payment fails or is reversed, we may pause or cancel scheduled service until the balance is paid.
5. Cancellations and changes
- More than 72 hours before scheduled delivery: cancel by email for a full refund of your deposit, less any non-refundable payment processing fees.
- Within 72 hours of scheduled delivery: up to the full deposit may be kept to cover vendor scheduling and dispatch costs.
- After the vendor has been dispatched or delivery has occurred: delivery and pickup charges are non-refundable.
- Construction and monthly rentals: you may end a rental at any time by requesting pickup. Rental is billed through the end of the current billing period unless your quote says otherwise.
- Rescheduling: one reschedule is free with at least 48 hours' notice, subject to vendor availability.
- Weather and events beyond our control: if severe weather, road closures, or similar events prevent delivery, we will work with you to reschedule or refund amounts paid for services not delivered.
6. Your responsibilities
- Provide accurate order details and a safe, accessible, firm, and level placement area that delivery trucks can reach.
- Get any permits or approvals needed for placement on streets, sidewalks, or other public property, and any property owner or HOA permission, unless your written quote says we will handle it.
- Do not move, tip, relocate, or alter units, dumpsters, or fence panels. Keep them secure from misuse and vandalism.
- Do not place hazardous or prohibited materials in dumpsters or portable toilets (for example, chemicals, paint, oil, tires, batteries, asbestos, or medical waste), and follow fill-line and weight limits. Charges for prohibited items, overloading, or extra cleaning will be passed through to you.
- You are responsible for loss of or damage to equipment while it is at your site, other than normal wear and tear.
7. Compliance information
ADA and OSHA guidance on the Site, and any sizing recommendations we give, are general information to help you plan. They are not legal advice. You are responsible for deciding how many and what type of units your event or job site needs to comply with federal, state, and local requirements.
8. Disclaimers and limitation of liability
The Site and its content are provided "as is." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
To the fullest extent permitted by law: (a) Go Go Porta Potty Plus is not liable for the acts or omissions of independent vendors, or for delays or failures caused by weather, traffic, site conditions, or other events beyond our reasonable control; (b) we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue; and (c) our total liability for any claim arising from an order or the Site will not exceed the amount you paid to us for the specific order that gave rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
9. Indemnification
You agree to indemnify and hold harmless Go Go Porta Potty Plus from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of rented equipment, prohibited materials, site conditions you control, missing permits you were responsible for, or your breach of these Terms.
10. SMS Program Terms
Program: Go Go Porta Potty Plus quote and order notifications.
- Opt-in: you can opt in by checking the SMS consent box on our contact form, which is unchecked by default. By opting in, you agree to receive text messages from Go Go Porta Potty Plus about your quote and order at the mobile number you provide. Consent is not a condition of purchase.
- Messages: quote follow-ups, order and delivery confirmations, scheduling and pickup updates, payment links and reminders, and customer care replies.
- Message frequency varies based on your quote and order activity.
- Msg & data rates may apply.
- To opt out, reply STOP to any message. You'll get one confirmation text, and then no further messages unless you opt in again.
- For help, reply HELP or email admin@gogoportapottyplus.com.
- Carriers are not liable for delayed or undelivered messages.
- You confirm that you are the account holder for the mobile number you provide, or have the account holder's permission, and that you are at least 18 years old.
- We do not share or sell mobile numbers or SMS opt-in data with third parties or affiliates for marketing purposes. See our Privacy Policy.
11. Governing law and disputes
These Terms are governed by the laws of the state or district where the rental services are performed (the District of Columbia, Maryland, Virginia, or Georgia), without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at admin@gogoportapottyplus.com and try in good faith to resolve the dispute informally for at least 30 days.
12. General terms
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. Your written quote may include additional terms for your order; if it conflicts with these Terms, the written quote controls for that order. We may update these Terms by posting a new version on this page with a new "Last updated" date. Changes apply to orders placed after the update.
